Per Glenn Bourchard (GB) 10/12/2020:
16 V.S.A. ยง 1075. Legal residence defined; responsibility and payment of education of pupils
(a) For the purpose of this title, except as otherwise set forth herein, the legal residence or residence of a pupil shall be as follows:
 (1) in the case of a minor, legal residence is where his or her parents reside, except that:
(A) if the parents live apart, legal residence is where either parent resides, but if a parent with sole custody lives outside the state of Vermont the pupil does not have a legal residence in Vermont;
And also in this section:

(b) The commissioner shall determine the legal residence of all state-placed students. In all other cases, the board of school directors of the district in which the pupil is living shall determine the pupil's legal residence. If a pupil is denied enrollment at any stage, the pupil and his or her parent or guardian shall be notified in writing, within 24 hours, of the provisions of this section. If the pupil is not in attendance as a result of a preliminary decision by school officials and a decision from the board of school directors will not be available by the end of the second school day after the request for enrollment is made, the commissioner may issue a temporary order requiring enrollment. Any interested person or taxpayer who is dissatisfied with the decision of the board as to the pupil's legal residence may appeal to the commissioner of education, who shall determine the pupil's legal residence, and the decision of the commissioner shall be final.

My question:
We have a student who just enrolled and has an unusual status. She:

Lives in Burlington
Attending WHS as School Choice
Enrolling in BTC classes

Glenn's response:
If this student is enrolled at Winooski High thru school choice, then Winooski should be reporting the student as a Burlington resident. Burlington will receive the ADM, Burlington should not report this student unless they leave Winooski and return to taking classes at Burlington High.

Follow up question: And so is it WHS that enrolls her in BTC?
Response: Yes.

Students Attending Out of State Placement (Conversation with Glenn) 10/4/2019

Question: We have a student who has been enrolled at Marvelwood School in Connecticut. It appears his parents still live in Burlington.
Response: Students attending an out of state school that the district is paying tuition for should be included on DC#05 Tuition Student Census.
Follow up: His parents live in Burlington so do we still count him as enrolled in BSD?
Response: No, he is not enrolled at BSD and should be exited if already on your Public School Census (DC#06). He should only be on the Tuition Student Census (DC#05).

GB 2/6/2019
Question: They are one of our Act 166 schools. Are they reporting also? Technically the student is enrolled with us when they attend an ACT 166 school.
Answer: It does not matter which school reports this student as long as the town of residence is listed correctly. You can both report the student, but Shelburne would need to change the Admission status to 07 Receiving services here, enrolled elsewhere and your Admission status should be 08 Enrolled here, receiving services elsewhere.
